This Monday, Justin T. Wiley, 32, of Fort Wayne, Indiana, was accused of illegally possessing a weapon and neglecting a dependant that resulted in serious physical harm. Due to prior felony convictions, he is not legally permitted to carry a gun, according to The Journal Gazette.

According to a probable cause document, Wiley was discovered on Sept. 9 by Fort Wayne police officers with a gunshot wound in his middle to upper back.

In the residence of a woman who has an active restraining order against him, he was shot. According to the affidavit, Wiley admitted to authorities that he had placed the gun on a bed before the 2-year-old son picked it up and fired it.

The woman reported hearing the gunshot to the police. Then Wiley shouted, “He shot me.”

According to the affidavit, the boy had oedema and blisters on his right pointer finger in addition to a gunpowder mark, and he kept saying “owie” while staring at his finger.

Following his initial court appearance on Monday, Wiley was released on bond.

The Associated Press called Wiley’s listed phone number on Thursday seeking comment on the allegations. There is no listed lawyer who can represent him in court documents.
