On Thursday, Judge David Strong, Jr., called a mistrial in the case of a father and son who were charged with attempted murder for shooting at D’Monterrio Gibson, a black FedEx driver in Brookhaven, Mississippi. The driver’s lawyer told that the father and son were accused of trying to kill Gibson.

Judge Declares Mistrial After New Information Surfaces During Testimony
The judge made his decision after a police officer who was testifying in the case shared information with the lawyers that had not been known before. Carlos Moore, Gibson’s lawyer, said that the defense had asked for the mistrial to be called. Brandon Case and his father, Gregory Case, were both charged with first-degree attempted murder, plotting, and shooting into Gibson’s car on January 24, 2022. Gibson was not hurt, but several bullet holes were found in his van and some items, according to a police report from January 25, 2022, that ABC News got. The report was filled out by Gibson and his boss at FedEx.
The Brookhaven city court said that the Cases’ lawyers said they were not guilty on their behalf. ABC News asked their lawyers for a response, but they didn’t answer right away. At first, the Cases were charged with severe attack. In November 2022, the charges were changed to first degree attempted murder. Gibson talked about the shooting in a previous “Good Morning America” interview. He said he was driving around trying to find the right house and finally did. He said that after he dropped off the package, Gregory Case tried to stop him from leaving the area by using his pickup truck.
“He tries to cut me off, and I knew what to do right away. “I went around him,” he told “GMA” on February 13, 2022. Gibson said that as he tried to leave, he saw Brandon Case standing in the middle of the road with a gun pointed at his delivery van. “When he passed him, the other person started shooting at his car. Gibson’s lawyer, Carlos Moore, told ABC News on Feb. 12, 2022 that the back of Gibson’s car had been hit several times. Before the trial started on Tuesday, Moore told ABC News that Gibson is still on paid leave from FedEx.
